Please read these Terms of Service carefully before using Virtual Eternal Peace. By accessing or using the Platform, you agree to be bound by these terms.

1. Acceptance of Terms

By accessing or using Virtual Eternal Peace (“the Platform”), you agree to these Terms of Service. If you do not agree, you must discontinue use of the Platform immediately.

2. Purpose of the Platform

Virtual Eternal Peace is an online memorial and tribute platform. Users may create and manage memorial profiles for deceased individuals, post tributes, and purchase optional digital offerings. For information on how we collect and use your data, please review our Privacy Policy.

3. Eligibility and Appropriate Use

You agree that you will:

  • Create memorials only for deceased individuals
  • Not create memorials for living persons without their explicit written consent
  • Not upload harmful, abusive, defamatory, hateful, or inappropriate content
  • Not impersonate others or misrepresent your identity
  • Not use the Platform for any illegal or unauthorized purpose
  • Not attempt to disrupt, hack, or compromise the security of the Platform

We reserve the right to remove content or restrict access for violations of these terms without prior notice.

4. User-Generated Content

You are responsible for any content you submit, including photos, text, and tributes. By posting content, you grant Virtual Eternal Peace LLC a non-exclusive, royalty-free license to display, host, and maintain that content on the Platform.

We may remove or disable content that:

  • Violates these Terms of Service
  • Is reported as inappropriate or abusive
  • Infringes on intellectual property rights
  • Disrespects the deceased or their families

5. Memorial Profiles

Virtual Eternal Peace is committed to keeping memorial profiles available long-term. However:

  • We cannot guarantee permanent storage or uninterrupted availability
  • We may archive or limit memorials only in cases of verified abuse, legal requirements, or critical technical necessity — never due to inactivity
  • We are not liable for loss of data, outages, or technical failures
  • When a funeral home transfers a memorial to a family member, ownership and management rights transfer to that family member

6. Payments and Subscriptions

Optional paid features include:

  • Wall of Remembrance placements (one-time fee)
  • Virtual candle lightings (one-time fee)
  • Funeral home partner subscriptions (monthly recurring fee)

All payments are securely processed through Stripe. Refunds may be granted at our discretion if requested within 7 days of purchase. Monthly subscriptions may be cancelled at any time with no cancellation fees. No automatic charges occur without your explicit consent.

7. Account Management

You are responsible for maintaining the confidentiality and security of your account credentials. We are not liable for unauthorized access resulting from compromised credentials. You may request account deletion at any time — your memorials will remain visible but become unmanaged upon deletion.

8. Intellectual Property

All branding, logos, design elements, and platform features are the property of Virtual Eternal Peace LLC. Users retain ownership of their uploaded content but grant us permission to host and display it on the Platform. The Virtual Eternal Peace name and infinity logo are trademarks of Virtual Eternal Peace LLC.

9. Termination

We may suspend or terminate access to the Platform at any time for:

  • Violations of these Terms of Service
  • Abuse of the service or other users
  • Legal or security concerns

Users may request memorial removal or account deletion at any time by contacting us.

10. Limitation of Liability

The Platform is provided “as is” without warranties of any kind. Virtual Eternal Peace LLC is not liable for:

  • Indirect, incidental, or consequential damages
  • Loss of memorial data or content
  • Service interruptions or technical failures
  • User-generated content posted by third parties

Your use of the Platform is at your own risk.

11. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of Florida, United States. Any disputes arising from these Terms shall be resolved in the courts of Florida. Virtual Eternal Peace LLC is a Florida limited liability company.

12. Changes to These Terms

We may update these Terms from time to time. We will notify users of material changes by updating the date at the top of this page. Continued use of the Platform after changes constitutes acceptance of the updated Terms.
